Terms relating to EYA Members

These terms relating to the Famly Partnership Programme (“Terms”) are the terms governing the discount offer that the members of Early Years Alliance (“EYA”) may be entitled to claim on the Famly platform subscriptions provided by Famly ApS (“Famly”). As a legally authorised representative of your organisation, you accept and agree to these Terms by booking a demo with Famly or by providing your valid EYA membership number to support@famly.co, provided you are a current customer. 

1. Introduction

Famly has entered into a Partnership Programme agreement with Early Years Alliance regarding certain discounts and/or offers. As a customer and a member of Early Years Alliance (“EYA Member”), you can benefit from offers on subscriptions to Famly. Such offers are made available to you by EYA (such as via the partner website, email newsletter, social media or by other promotional material). 

If you are currently not a customer of Famly, you may be entitled to the Famly Offer set out in clause 2. 

If you are already a customer of Famly and hold a valid and active EYA membership, you may be entitled to the Current Customer Offer set out in clause 5.

2. The Famly Offer

You as an EYA Member are entitled to a special Famly Offer as set out below, provided that you meet the eligibility criteria in clause 3.

If you enter into an agreement with Famly and purchase an annual Professional, Premium or a Childminder subscription package, you’ll receive the following discounts: 

  • fixed 20% discount on the first year subscription; 
  • fixed 10% discount on the second year subscription; and
  • fixed 5% discount on the third year subscription.

Thereafter, the subscription price will be as listed on the Famly website. The subscription fees for all Famly subscriptions must be paid annually in advance.

3. Eligibility Criteria for the Famly Offer

You qualify for the Famly Offer provide that:

  1. You can demonstrate that you hold a valid and active EYA membership, and in order to be eligible for the ongoing discount you must hold a valid EYA membership at the point of the annual subscription renewal;
  2. You are a new customer to Famly or you have not had a contract with Famly in the last 12 months prior to the date of claiming the Famly Offer;
  3. You have made use of a valid partner link on the dedicated EYA page on Famly’s website; 
  4. You have become a Famly customer on an annual subscription, and accepted the Famly Terms and Conditions, within 3 months of receiving a demo from Famly;
  5. You have accepted the Famly Terms and Conditions before December 31st, 2028; and 
  6. You remain on an annual subscription for the duration of the discounted period.

4. Limitations to the Famly Offer

The Famly Offer can only be claimed once per new Famly customer/EYA Member. Alternatively, if an EYA Member has previously held a contract with Famly and wishes to claim the offer again, at least 12 months must have passed since the end of their contract with us.

You cannot combine the Famly Offer with any other offers and/or discounts to Famly subscription packages for the duration of the 3 year discounted subscription period. 

5. Famly x EYA Current Customer Offer & Limitations

If you are already a Famly customer and an EYA Member, and as such do not meet the eligibility criteria in clause 3, you are entitled to a 10% discount for 1 year (“Current Customer Offer”), provided that you meet the requirements below:

  1. you can demonstrate that you hold a valid and active EYA membership at time of the subscription renewal; and
  2. you have previously not benefited from a discount to Famly subscriptions due to your EYA membership.

You cannot combine the Current Customer Offer with any other offers/discounts to Famly subscription packages for the duration of the 1 year renewal discounted subscription period.  

If you have an annual subscription, the 10% discount will be applied to the invoice for the next annual subscription renewal. If you have a monthly subscription, the 10% discount will be applied to the monthly invoice for the next 12 months.

6. Discount Ends

If you cease to meet the eligibility criteria at any point during the discounted period, Famly reserves the right to immediately revoke your discount. In such cases, you will be charged the standard price listed on our website for the remainder of your contract with us. 

7. Price Changes

If, in accordance with clause 7.5 of the Famly Terms and Conditions, Famly will make any changes to its pricing during your discounted period, your discount (based on your subscription year) will apply to the adjusted price.  

8. Claiming the Famly Offer and Current Customer Offer

Upon meeting the eligibility requirements for the Famly Offer, the applicable discount will be deducted from the annual subscription in your contract with Famly.

Upon meeting the eligibility requirements for the Current Customer Offer, the 10% discount will be deducted from your annual or monthly subscription in your contract with Famly.

9. Disputes

Any disputes arising under or in connection with these Terms are governed by the laws of Denmark, and any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Danish courts.  

10. Changes to these Terms

Famly retains the right to modify or update these Terms at any time.
